LIVINGSTON PLANNING BOARD

September 05, 2012

 

The regular monthly meeting of the Livingston Planning Board was held on September 05, 2012 and opened at 7:00 p.m. In attendance were Chairman Larry Hermance, Chip Keil, John Alvarez, Martin Schroeder, James McFarland, Frank Santacroce and Philip Schmidt. Attorney Theodore Hilscher Engineer Jay Trapp CEO Thomas Jacques.

Absent: Bernie Stickles

A motion to accept the minutes of the August O1, 2012 meeting was made by Chip Keil and 2nd by John Alvarez. All voted AYE. Motion passed unanimously.


The hearing for Mark Eger continued a site plan application to replace 2 existing 190 feet communications towers and erect one heavy duty 190 foot tower. Mr. Eger called and requested to be deferred to the October meeting.

The Board decided to keep the hearing open and the hearing is to continue at the October meeting.


The public hearing for Jodi Jacque represented by Thomas Jacque a lot line adjustment opened at 7:03. Property located 993 County Route 19. Fee paid.

No comments from the public or written correspondence were received concerning this application. The public hearing closed at 7:05.

Attorney Ted Hilscher prepared the short form SEQRA and reported the results to the Board.

A motion to approve a negative declaration for the short form SEQRA was made by Martin Schroeder and 2nd by James McFarland. All voted AYE. Motion passed unanimously.

A motion to approve the Jodi Jacques subdivision application as submitted was made by Martin Schroeder and 2nd by Philip Schmidt. All voted AYE. Motion passed unanimously.


Fumbo Realty submitted a site plan with multiple uses. Property located 677-679 County Route 2, consisting of 1.968 acres.

The applicants outlined the project for the Board.

  1. It was decided by the applicants to withdraw the proposed storage units to make one less use for the property.

  2. The existing post office and the 5 apartments will remain.

  3. The farm markets on wheels are seasonal no definite size yet.

  4. The farm markets are not considered an accessory non use under zoning laws.

  5. Markets open June to December. Need to define products to be sold.

  6. Applicant will need to change the application to the ZBA from a special use to an area variance to be able to have the Farm markets due to many uses on the 2 acres. And to return to the ZBA. A letter will be sent to the ZBA informing them of the change.

  7. Applicant to return to the October meeting with new maps.


Discussion:

Burke St. John was unable to attend the meeting and give an update on the Hudson Park project.


Columbia Ice and Storage did not attend with an updated site plan as required by the Livingston Town Court.


There being no further business before the Board a motion to adjourn was made by Chip Keil 2nd by Frank Santacroce. All voted AYE. Motion passed unanimously.

Next scheduled meeting will be held October 05, 2012. Meeting closed at 7:55 p.m.
