LIVINGSTON PLANNING BOARD
February 02, 2011 meeting cancelled due to weather.
February 09, 2011
The regular monthly meeting of the Livingston Planning Board was held on February 09, 20011 at 7:00 p.m. In attendance were Chairman Larry Hermance, Bernie Stickles, James McFarland, Chip Keil, and Philip Schmidt. Engineer Jay Trapp. Attorney Theodore Hilscher.
Absent: John Alvarez Frank Santacroce Martin Schroeder
A motion to accept the minutes of the January 05, 2011 meeting was made by Chip Keil and 2nd by James Mc Farland. All voted AYE. Motion passed unanimously.
Correspondence: A letter was received from the Columbia County Planning Board recommending that the application Columbia Ice and Storage for a U Haul franchise be a local decision.
7:02. the public hearing continued for Antonia Rutigliano represented by Robert Zimmerman a lot line adjustment to combine 2 lots to his existing owned lots. Combining North West lot 163 to be combined with lot 161 and lot 162 to be combined to 1 /2 of lot 163. Property located Loyola Road and Helen Road. Fee paid.
No comments were received from the public and no written correspondence was received concerning this application. New maps showing the house and tax bills were received.
Attorney Ted Hilscher prepared the SEQRA form and asked the Board the required questions.
A motion to approve the SEQRA as prepared with a negative declaration was made by Chip Keil and 2nd by Philip Schmidt. All voted AYE. Motion passed unanimously.
A motion to approve the Antonio Rutigliano subdivision as prepared was made by Chip Keil and 2nd by James Mc Farland. All voted AYE. Motion passed unanimously.
The hearing for Mark Eger continued a site plan application to replace 2 existing 190 feet communications towers and erect one heavy duty 190 foot tower.
Attorney Gagen responded with the required information.
A book containing the completed application will be left with the Town Clerk Cynthia Hapeman to be left in the lobby for all to look at it during regular Town Clerk's hours.
A motion to accept the Eger application complete was made by Chip Keil and 2nd by Philip Schmidt. All voted AYE. Motion passed unanimously.
The Board decided to keep the hearing open for further discussion and to allow a review of the application. Hearing is to continue at the March meeting.
Jay Lord, Senior Site Engineering Project Manager and Bill Hoffman, Engineer representing Hannaford Bros. Co. gave an update on the project.
The electric supplier was changed to reflect the correct one.
The propane tanks will be underground at the same location.
The height of the gable has been reduced to meet the zoning requirements.
An application is before the ZBA for the 100 parking spaces. A public hearing will be held March 01 2011.
Merger of lots needed are in progress.
Parks and Recreation has approved the project.
New well has been drilled down to bedrock and had to be hydro fractured.
72 hour test will be done in the future.
DEC approval is still needed.
Curb cuts are under review.
A motion to have the Planning Board deem the application complete at this stage was made by James Mc Farland and 2nd by Chip Keil. All voted AYE. Motion passes unanimously.
A motion to make the Livingston Planning Board lead agency for the SEQRA process for the Hannaford application was made by James Mc Farland and 2nd by Bernie Stickles. All voted AYE. Motion passed unanimously.
Applicant will return to the March meeting.
A motion to grant final approval of the original Columbia Ice and Storage application for a special use permit granted at the November 03 2010 meeting that was contingent on afproval from the Columbia County Planning Board was made by Philip Schmidt and 2n by James Mc Farland. All voted AYE. Motion passed unanimously.
There being no further business before the Board a motion to adjourn was made by Chip Keil and 2nd by Bernie Stickles. All voted AYE. Motion passed unanimously.
Next scheduled meeting will be held March 02. Meeting closed at 7:53 p.m.
