Minutes
Before the meeting began Warren Replansky requested a private meeting with the Board to discuss the case.
Meeting started with the Pledge of Allegiance at 19:23.
Roll call at 19:24.
Reading of the May meeting minutes by Kyle Nilan. Motion to accept the minutes was made by David Kimball, seconded by Jason Munz. All in favor; motion approved.
Kyle Nilan read the correspondence, an open letter to the neighbors of Sloan Schaffer by an anonymous resident of Cold Spring Rd.
Thomas Alvarez announced that the public hearing would be postponed so that an environmental review could be performed by the Planing Board first.
Warren Replansky, introduced himself as special counsel for the case.
Warren Replansky said that the ZBA could not rule on the area variances until an environmental review had been performed by the leading agency. He said that a long form environmental assessment should be performed to determine the lead agency, which would then make a ruling before the area variance would be seen to.
Attorney Janis Gomez Anderson introduced herself as Sloan Schaffer’s attorney and said she would like to speak on the record. Ms. Gomez Anderson clarified that there are variances requests being made, one 18' and one about 25', and that the area variance would be because the barn at issue does not meet the 500' required setback.
Janis Gomez Anderson said there was a negative declaration made for a related lot line adjustment and so she believes this is a type two request under SEQR and requires no review under SEQR. Because of this and that the requested use is legal within the district, as well as the long process her client has already gone through she requested the public hearing be opened and conducted.
Warren Replansky said he was fine with opening the public hearing if the board wanted to, with the understanding that no determination would be made on the variance until after the environmental review was done.
Thomas Alvarez asked if the application and map stated exact, accurate numbers. The map, which was updated, had accurate numbers. The application itself had inaccurate numbers. Janice Gomez Anderson said that she would be happy to amend the application to match the map.
A vote to postpone the public hearing was postponed for one month by the majority.
David Kimball asked Janis Gomez Anderson to make certain with Sloan Schaffer would not be need for additional variances before the ZBA rules on the present requests.
Janis Gomez Anderson suggested the code enforcement officer review the entirety of the application again to make certain there would be no others.
Thomas Alvarez asked Janis Gomez Anderson to speak to any events currently taking place on the property that don’t conform to the zoning laws. She said it was a private, noncommercial and legal event.
Jason Munz asked about a basket workshop planned for July 25th for $250 a ticket. Janis Gomez Anderson said it would not take place without the variance approvals. She clarified there would be no commercial events at the property until that.
Janis asked again to open the public hearing without decision so that Sloan Schaffer did not have to send out certified mail again.
Thomas Alvarez decided to open and adjourn the public hearing.
Shawn Kemp an attorney for a neighbor Lucinda Tree(?) introduced himself and said that the public hearing should be put off based on the lack of information and that the board has already voted to hold off.
Jason Munz added that the applicant’s notice sent to the public was very vague.
Thomas Alvarez decided not to open the public hearing due to insufficient information on the application.
A motion to adjourn was made by Sarah Price, seconded by David Kimball. All in favor; motion approved.
Next scheduled meeting will be held Jul 14, 2026 2026.
